Licensing Status

Hayley E. Rohn is currently only licensed to practice law in Michigan. The website and the legal services provided by Hayley E. Rohn are only related to Michigan law. Therefore, Hayley E. Rohn will not represent or assist anyone needing representation or assistance based on viewing the website in any state other than Michigan.

Scope of Services

The scope of legal services which Hayley E. Rohn PLLC will perform for you will be expressly agreed upon in writing in the form of a Retainer Agreement and signed by you before any legal services are performed. It will not include any services that have been expressly excluded or are otherwise outside the scope of the Retainer Agreement.

If services outside the scope of the Retainer Agreement are required, the client may pose a separate question regarding the legal services or request a price quote for additional legal work. Hayley E. Rohn PLLC will not pay any court costs associated with your case which may be required as part of a lawsuit, filing fees or service of process fees.

Establishment of Attorney-Client Relationship

An attorney-client relationship will not be established until Hayley E. Rohn has expressly communicated the ability to represent a client.  That relationship will then be formalized by a Retainer Agreement signed by Hayley E. Rohn, on behalf of Hayley E. Rohn PLLC, and the client(s).

Hayley E. Rohn may decline to represent you if a possible conflict of interest is discovered or if she believes your legal needs cannot be addressed by Hayley E. Rohn PLLC.

The transmission of information from contact forms on the website, through the Client Portal Account, and/or any communication with Hayley E. Rohn (whether via e-mail, the phone, or through the website) will not, by itself, establish an attorney-client relationship.   Just because a Client Portal Account is created for you online does not, by itself, mean an attorney-client relationship has been established.

If Hayley E. Rohn determines during her communication with you that your specific legal matter requires the engagement of a full service law firm, such as in the event that your situation may require the commencement of a formal lawsuit, then she will promptly refer you to a full-service firm in your area.

Termination of Attorney-Client Relationship

As said above, an attorney-client relationship with prospective clients is established only after Hayley E. Rohn has expressly communicated the ability to accept representation of your matter.

Once an attorney-client relationship is formalized by a signed Retainer Agreement, the client has the right to terminate the relationship with or without cause at any time. If the client decides to terminate the attorney-client relationship, the client will only be obligated to pay for the services performed up until the date the cancellation was communicated to Hayley E. Rohn. Any outstanding funds for services not performed will be refunded to the client within 14 business days.

Hayley E. Rohn PLLC also reserves the right to terminate the attorney-client relationship and withdraw from representation in accordance with the Michigan Rules of Professional Conduct.

Client Portal Account

Hayley E. Rohn PLLC provides clients and potential clients the ability to create a Client Portal Account and access certain attorney-client communications with the office and client documents through an online personal Client Portal Account available through the website. This secure Client Portal Account is provided by a reputable third-party online practice management software called MyCase. (For more information about MyCase and its security feature, please see here.)

To create a client Portal Account, you will have to enter certain personal information and request a Login ID and password.  Creating a Client Portal Account does not, by itself, establish an attorney-client relationship with Hayley E. Rohn. However, any information received by Hayley E. Rohn and Hayley E. Rohn PLLC through the registration process will be held in confidence. Hayley E. Rohn PLLC does not sell or otherwise disclose to third parties any information that you provide except as may be required by law or in response to an investigation by law enforcement or other government authorities.

By registering for, and creating, a Client Portal Account, you acknowledge and agree that you have read and agree to these Terms & Conditions, that you understand the security processes that Hayley E. Rohn PLLC maintains, and that there are always risks inherent with the transmission, storage, viewing and retrieval of data and files over the internet, including through the website. You are solely and fully responsible for the security of your Login ID and password and for any consequences that arise out of your failure to maintain the confidentiality of that information. You must notify our office of any unauthorized use of a breach in security of your Client Portal Account. Your right to use your Client Portal Account is personal to you, is for your personal and individual use, and you will not permit any others to use it. Hayley E. Rohn PLLC reserves the right to suspend, revoke or terminate your use of the website and/or your Client Portal Account at any time without notice to you.

Client Funds

As a web-based law office, payment of fees invoiced to clients can be processed online through the Client Portal Account with your credit card.  The Client Portal Account is supported by a third-party secure practice management software called MyCase which also allows clients to directly pay their fees online with credit cards and checking accounts (also known as eCheck or ACH payments).

In most situations, a client’s funds will not be transferred to Hayley E. Rohn PLLC until the legal services requested by the client are ready to be accessed through the Client Portal Account by the client.

In other situations, some services may require payment of a retainer fee (i.e., an upfront payment) before Hayley E. Rohn can begin work. After payment of such retainer fee is processed online and confirmed, the client will have complete access to the legal advice, documents, research or other services provided by the attorney.

Security

All communications are done through the website and through your Client Portal Account are done over Secure HTTP, which provides you with the highest industry standard protection available on the internet. All payments are processed by Cardholder Information Security Program (CISP) compliant credit card processors, and no credit card or payment account numbers are stored on our servers.

The software that supports this virtual law office platform, known as MyCase, is a reputable provider of the service and has experience in developing secure web-based applications and programming techniques.

Severance

In the event that one or more of the provisions of this agreement shall be found unenforceable, illegal or invalid, it shall not affect any other provisions of these Terms & Conditions, and these Terms & Conditions shall be construed as if the provision found to be unenforceable, illegal or invalid had never been contained herein, or the unenforceable, illegal or invalid provision shall be construed, amended and/or reformed to be made enforceable, legal and valid.

Cookies

The website uses session cookies to ensure that your computer displays the site effectively. You have the ability to accept or decline cookies using your web browser settings. If you choose not to accept cookies from the website, you may not be able to take full advantage of its features or to receive some of the services the website provides.

Each person who registers for a Client Portal Account on the website consents irrevocably to personal jurisdiction in such courts with the respect to any matters and waives any defense of forum non conveniens. Furthermore, each person who registers for a Client Portal Account on the website is deemed to have knowingly and voluntarily waived any right to a trial by jury in any case or controversy related to these Terms & Conditions, the website, and any services provided by Hayley E. Rohn PLLC.

Limitation of Liability – No Warranties

The information presented on the website is provided “as is” and “as available,” without representation or warranty of any kind. Hayley E. Rohn PLLC does not represent or warrant that such information is or will be always current, complete, or accurate. Any representation or warranty that might be otherwise implied is expressly disclaimed. Hayley E. As with any legal service, we cannot guarantee any legal outcome. No website or other materials published on the website should be construed as a guarantee of any particular outcome or result.

Modification
